What it is
Many developments need both a change of zoning and the creation of new erven. Where the municipal by-law allows, the two can be applied for together so that one motivation, one round of public participation and one decision cover both.
When you may need it
- You want to subdivide and the new portions need a different zoning
- A small residential development needs both higher density and separate title
What our work includes
- Check whether combined processing is permitted locally
- Joint layout, motivation and application
- Coordination with the land surveyor
- Follow-through on conditions for both components
The broad process
- 1.Feasibility and layout
- 2.Combined submission
- 3.Public participation and circulation
- 4.Decision
- 5.Survey, conditions and registration
Documents commonly required
- Copy of the title deed (later stage, not at enquiry)
- Surveyor-General diagram or general plan
- Zoning certificate or current land-use information
- Power of attorney and owner consent where applicable
You don’t need these to make an initial enquiry.
What affects cost and duration
- Professional planning fees for preparation and motivation
- Municipal application fees set by the relevant municipality
- Advertising and notice costs where public participation is required
- Specialist reports (for example traffic, engineering services or environmental)
- Survey, conveyancing and services contributions
We provide a project-specific quotation that separates professional fees from municipal charges, advertising and specialist costs. Timeframes vary with scope, completeness, objections, specialist work and municipal processing.
Limitations
Not every municipality processes the components together, and each component may be approved or refused on its own merits.
